Agreement Between User and smartObjx

The smartObjx Web Site comprises various pages operated by smartObjx, offered conditionally upon acceptance of all terms, conditions, and notices herein.

smartObjx reserves the right to change terms, conditions, notices, and charges associated with the Web Site.

No Unlawful or Prohibited Use

smartObjx reserves the right to review, remove, and terminate access to Communication Services at any time without notice. Users should exercise caution sharing personally identifying information. smartObjx disclaims liability regarding Communication Service contents and user participation.

Materials Provided to smartObjx or Posted at smartObjx Web Sites

smartObjx does not claim ownership of user-provided materials or submissions. By posting, uploading, or submitting content, users grant smartObjx and affiliated companies permission to use submissions in connection with Internet business operations, including rights to copy, distribute, transmit, display, perform, reproduce, edit, translate, and reformat submissions, and publish the user’s name in connection with submissions.

No compensation will be paid for submissions. smartObjx has no obligation to post or use submissions and may remove them at any time. Users warrant they own or control all rights to submissions.

In no event shall smartObjx and/or its suppliers be liable for any direct, indirect, punitive, incidental, special, or consequential damages, or damages for loss of use, data, or profits, whether based on contract, tort, negligence, or strict liability. Some jurisdictions do not allow liability limitation exclusions. If dissatisfied, users’ sole remedy is discontinuing site use.

Termination/Access Restriction

smartObjx reserves the right to terminate user access at any time without notice.

General

The agreement is governed by Washington State law. Users consent to exclusive jurisdiction and venue of courts in San Mateo County, California. No joint venture, partnership, employment, or agency relationship exists. smartObjx’s performance is subject to existing laws and legal process. If any provision is invalid, it will be deemed superseded by a valid provision most closely matching the original intent.

This agreement constitutes the entire agreement and supersedes all prior communications.

Notices and Procedure for Making Claims of Copyright Infringement

Notifications of claimed copyright infringement under Title 17, United States Code, Section 512(c)(2), should be sent to the Service Provider’s Designated Agent. Only relevant inquiries receive responses.
